* إن هذا الطرح ليس جديدا من حيث المنطق التفسيري(الفلسفي) فهو أمنية الانسان وتطلعه منذ كان، ولو راجعنا وجهات النظر الفلسفية عبر التاريخ لوجدناها تحمل هذا المعنى أو شيئا مقاربا له.. فحتى(هوبز) الفيلسوف الانجليزي المعروف بمناصرته للملكية ضد الجمهورية، والذي تعتبره الدراسات الفلسفية والاجتماعية نصيرا للملوك ومعاديا للجماهير الشعبية، كان قد نادى في واقع الأمر بأن السلطة لا يمكن أن تتجزأ. وهو ما فسر له تفسيرا سطحيا، فاعتبر مناصرا للملوك، في حين أنه قال بعدم جدوى مشاركة الملك في السلطة.. ولقد وقف(هوبز) ضد البرلمان الذي شارك الملك تشارلز السلطة في بريطانيا بسبب تحليله الخاص عن عدم تجزؤ السلطة. وثبت بعد ذلك صدق تحليله حين أدى تجزؤ السلطة إلى حرب أهلية في بريطانيا.عرف(هوبز) أن الملك يجسد السلطة- في ذلك الوقت- وإنه لا فائدة من تقسيم السلطة وتدريجها بحسب الاختصاصات، لأن المسألة ليست كما يراها المحللون السياسيون، بل هي أعمق من ذلك كثيرأ، فالصراع الجاري حاليا كانت تفاعلاته قد تراكمت منذ أن تجزأت السلطة ببن الملك والنواب. والحل العلمي والسليم هو أن تمارس السلطة ككل من طرف جهة واحدة.. وحيث لم يكن الشعب مطروحا كأداة حكم في المجتمعات القديمة، وليس من الممكن أن يتنحى الملك لأحد، طرح هوبز الملك وحده أداة للسلطة. ولم يحظ طرحه هذا الا بتفسيرات سطحية وصمته بأنه مضاد للديمقراطية، لأنه مضاد للنواب!. وبأنه داعية للدكتاتورية بسبب دعوته إلى انفراد الملك بالسلطة، ولكن صار بإمكاننا الآن أن نقول بعدم تجزئة السلطة، وإن السيادة لا يمكن أن تتجزأ، وإن أية تجزئة لها هي تحطيم لها. ولكننا نطرح أن تتجسد السلطة والسيادة في الشعب، بأن تقوم الجماهير الشعبية بإلغاء أية أداة للسلطة من ملوك ونواب.. وأحزاب. ان الحزب جزء من الشعب وسيادة الشعب لا يمكن تجزئتها، فحين يدعى حزب بأنه يمثل السيادة فهو في الواقع يحطمها ويدمرها. فالسيادة تمارس كاملة.. أولا تمارس.. فإما أن تمارسها الجماهير، وتكون سيادة حقيقية وكاملة، أو تزيف بممارسة فرد لها أو بممارسة حزب أو جبهة أو مجموعة أحزاب. ان تحديد أداة السيادة تحديدا لا يقبل المشاركة هو الحل السليم، فلا توجد مشاركة شعبية في السلطة، فإما أن يمارس الشعب السلطة كاملة.. وإما أن يمارسها غيره.. ولا وسط على الاطلاق. فسيادة الشعب لا تتجزأ ولا يمكن التنازل عنها أو عن جزء منها. ولذلك يكون الحل العلمي السليم هو أن يمارس الشعب سيادته كاملة وينفذ سلطته مطلقة دون شريك له فيها. فلا يجوز مثلا أن يؤتى بفرد، ويمنح نسبة في السلطة والسيادة 25% مثلا لأنه ممتاز ومخلص أو متفوق. ولا يجوز أن يؤتى بجهة ما وتمنح أي قدر من السلطة مهما كان ضئيلا ومهما كانت الأسباب الداعية إلى ذلك. فإذا حدث شيء من هذا فليس سوى عبث لا يجب أن يستمر حتى ليوم واحد. إن رؤيا(هوبز) عن السلطة صحيحة من الناحية النظرية، فقد ثبتت استحالة تجزئة السلطة وتجزئة ممارسة السيادة. خاصة وإن الذين يمارسون السيادة سيتكفلون بسن القوانين، ومن المعروف في نظرية القانون(إن القانون تجب طاعته)، ويحاسب أولئك الخارجون عن القانون والمخالفون لنصوصه كمجرمين، وهى مشكلة معقدة أخرى تضاف إلى المشكلة التي ذكرناها وهي تجزئة السيادة. إن المواطن الخارج عن القانون والمتمرد عليه لديه المبررات التي تجعله يفعل ذلك، دون أن يسمح بوصمه بالأجرام وبالخروج عن العدالة. فلماذا يخرج المواطن عن القانون؟ فلو كان القانون شيئا جميلا، فلماذا لا يتبعه المواطن؟ إن المواطن حقيقة يحس بالتناقض بينه وبين القانون ويرى بأنه غير عادل، وبالتالي لا تجب طاعته وإنما يجب التمرد عليه ومخالفته. لكن القوانين تقول بارغام هذا المواطن على طاعتها، ولو بقطع رأسه واعدامه. إن اغتصاب الطاعة هنا رغم أنف الجماهير الشعبية هو يحد ذاته أزمة حقيقية لا يمكن تجاهلها في الفكر السياسي والاجتماعي. إن آلاف الناس يموتون كعقاب لهم على خروجهم عن القوانين، وهم يسألون لماذا يجب أن نطيع القوانين؟. فيجابون.. لأنها عادلة! إن الناس يسلمون معنا بأن(القانون يجب أن يطاع) ولكن هل معنى هذا أن القانون لا خطأ فيه؟ ولكنهم يقولون هل المطلوب منا

مثلا:- أن نطيع تلك القوانين التي صنعها النواب والوزراء والحكام والأمراء؟ وباعوا بها أوطاننا وكرامتنا وحرياتنا، وصاغوا خلالها مصالحهم المادية مواد محددة وبنودا مبوبة.. ووضعوا أنفسهم في وضع الحصانة القانونية التي لا يجوز المساس بها لا قولا ولا عملا كالعبارة التي ترد عادة في بعض الدساتير” الملك مضون.. وغير مسئول” أو “ظل الله في الأرض” أو كتلك الاتفاقيات المجحفة التي تفرضها دولة كبرى على شعب صغير، أو كتلك القوانين السياسية أو الاقتصادية أو الاجتماعية.. التي تمايز بين الطبقات، وتجعل طبقة تعمل كعبد لطبقة أخرى وتضع أراضي الدولة كلها ملكا لطبقة محدودة من أفراد المجتمع. وقوانين العمل وعقود الايجار التي تمنح حقوق العمال والأجراء لآخرين لاحق لهم فيها… Etc.. هل يطلب إلينا أن نطيع القوانين؟ هل أعمل عشر ساعات وأسمح لآخر وفقا للقانون أن يسرق منها خمساً؟ هل أسمح لنفسي بالبقاء في الصحراء بلا مأوى، وموارد بلادي كلها حكر على عدد محدود من الناس، فإذا حاولت الحصول على بيت، ساقوني إلى للمحكمة وحوكمت بالسرقة لأنني اعتديت على عمارة الرأسمالي، الذي يملك عشرات العمارات من ثروة بلادي وعرق عمالها؟.. كيف تطاع مثل هذه القوانين؟ إن الناس في الواقع لا يرون مبررا لطاعة القوانين سوى الخوف! وإذا لم يكن كذلك، فكيف نفسر قبول الناس للقوانين التي تصدر عن حزب يستولي على السلطة متضمنة أنه صاحب البلد بلا منازع؟. وإن رئيس الحزب هو رئيس الدولة وقائد الجيوش، الذي بيده مفاتيح كل شيء. ولو خالفه أي من المواطنين أو حتى استفسر عن هذه الوضعية غير المنطقية، اعتبر بالقانون متمردا ومعارضا ومعاديا.

إن الخرف وحده هو الذي يجعل الناس تطيع القوانين رغم عدم اقتناعها بها. بينما تطالبهم كتب الأديان السماوية والوضعية وعلوم الاجتماع والتاريخ والنفس كلها، بطاعة القانون، لأنه عادل.

ولكن الناس يعرفون بأن القوانين ليست عادلة. وقد وضعتها أدوات مشكوك بنزاهتها، وليست مؤهلة بطبيعتها لوضع قوانين عادلة.

* فمن أين يأتي القانون العادل الذي تجب طاعته، ونعامل الناس وفقا لمضامينه؟.. إنه القانون الذي يصنعه الناس بأنفسهم لأنفسهم. فيضعون قوانينهم المعبرة عن مشاعرهم وأحاسيسهم والمتضمنة لأمانيهم وطموحاتهم. حاملة رؤاهم للحياة الخبرة التي يرغبون. وحين يصوغ الانسان القانون بنفسه ولنفسه، فإنه لا يجد مبررا لعدم طاعته، لأنه سيكون في نفس الوقت قادرا على تعديله وإلغائه أيضاً، فلا شيء يجبره على اتباعه سوى رغبته في تطبيق القانون ذاته.

* ولكن كيف يتسنى ذلك من الناحية العلمية؟ أي كيف يمكن للجماهير الشعبية أن تصوغ كلها قانونها الذي تريده، لكي تطيعه؟ لقد أصبح هذا ممكنا من الناحية العلمية عن طريق المؤتمرات الشعبية، حيث تقسم الجماهير الشعبية نفسها جغرافيا إلى مؤتمرات شعبية، ويعرض الأمر عليها فيكون لجميع الأفراد حقهم في ابداء وجهات نظرهم، ليصاغ بعد ذلك قانون جماعي من خلاصة آراء جميع المؤتمرات الشعبية، فيكون هذا هو القانون العام الذي سيطيعه الناس لأنهم صنعوه لأنفسهم برغبتهم فلا يعارضونه ولا يتمردون عليه، ولا يشكون في مصدر تشريعه، فإذا ظهر خطأ بعد ذلك في هذا القانون فإن المواطنين الذين صاغوه أنفسهم يملكون حق تعديله ونقضه وإلغائه، أو استبداله بقانون غيره. إنها الطريقة الوحيدة لمعالجة أزمة القانون علاجا حقيقيا ومنطقيا. وهى الوسيلة الوحيدة أيضاً لبناء حياة جديرة بأن يتمتع بها الإنسان.
